Acceptable Use Policy

This policy applies to all Members, Affiliates, and visitors of the The Open Window Academy platform.
1. Purpose
This Acceptable Use Policy ("AUP") outlines the rules and guidelines for using the The Open Window Academy platform ("Platform") operated by The Open Window Academy LLC ("Company"). This policy is designed to protect the Company, its Members, and the integrity of the The Open Window Academy community. All users must comply with this AUP in addition to the Terms and Conditions.
2. Prohibited Conduct
You agree NOT to engage in any of the following activities while using the Platform or representing The Open Window Academy:
2.1 False Income Claims & Misleading Representations
- Making false, exaggerated, or misleading income claims or earnings representations.
- Guaranteeing specific income levels or financial outcomes to prospective Members.
- Sharing income screenshots or testimonials without proper context and disclaimers.
- Representing that income is "easy," "automatic," or "guaranteed."
- Misrepresenting the nature of the business opportunity, products, or compensation plan.
- Failing to disclose your material connection to the Company when promoting The Open Window Academy (FTC requirement).
2.2 Spam & Unsolicited Communications
- Sending unsolicited bulk emails, messages, or communications promoting The Open Window Academy.
- Posting promotional content in online communities, forums, or social media groups where such posts are prohibited.
- Using automated tools, bots, or scripts to send messages or create accounts.
- Purchasing email lists or contact databases for promotional purposes.
- Violating the CAN-SPAM Act, GDPR, or other applicable anti-spam regulations.
2.3 Fraud & Manipulation
- Purchasing memberships through your own referral link (self-referral fraud).
- Creating multiple accounts to manipulate referral tracking or commission calculations.
- Using fake identities, stolen payment methods, or fraudulent information.
- Coordinating with others to artificially inflate referral numbers or commission earnings.
- Exploiting bugs, glitches, or vulnerabilities in the Platform for personal gain.
- Filing false chargebacks or payment disputes.
2.4 Unauthorized Access & Technical Abuse
- Attempting to gain unauthorized access to any portion of the Platform, other user accounts, or connected systems.
- Using automated means (bots, scrapers, crawlers) to access the Platform without express written permission.
- Reverse engineering, decompiling, or disassembling any part of the Platform.
- Interfering with or disrupting the Platform's servers, networks, or infrastructure.
- Uploading malware, viruses, or other harmful code.
- Circumventing any security measures, access controls, or usage limits.
2.5 Harmful Content & Behavior
- Uploading, posting, or transmitting content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Promoting violence, hatred, discrimination, or any harmful acts.
- Impersonating any person or entity, or falsely representing your affiliation.
- Sharing another user's personal information without their consent.
- Engaging in bullying, harassment, or intimidation of other Members or Affiliates.
3. FTC Compliance Requirements for Affiliates
All The Open Window Academy Affiliates must comply with the Federal Trade Commission's guidelines on endorsements and advertising. Specifically:
- Disclosure: You must clearly and conspicuously disclose your material connection to The Open Window Academy in all promotional content, including social media posts, blog articles, videos, emails, and personal conversations.
- Truthfulness: All claims about products, services, and the business opportunity must be truthful, substantiated, and not misleading.
- Testimonials: If sharing testimonials or results, you must include appropriate disclaimers that results are not typical and individual results may vary.
- Income Claims: Any income examples must be accompanied by a clear disclaimer and must reflect realistic expectations, not best-case scenarios.
Example disclosure: "I am a The Open Window Academy Affiliate and may earn commissions from purchases made through my referral link."
4. Content Standards
When creating content using The Open Window Academy tools or promoting The Open Window Academy products, you must:
- Ensure all content complies with applicable laws and regulations.
- Not create content that infringes on the intellectual property rights of others.
- Not use The Open Window Academy's AI tools to create deepfakes, non-consensual intimate imagery, or content designed to deceive or defraud.
- Not create content that promotes illegal activities.
- Respect the Company's brand guidelines when using The Open Window Academy logos, trademarks, or branding materials.
- Not misrepresent AI-generated content as human-created when disclosure is required by law or platform policies.
5. Intellectual Property
You may not:
- Copy, reproduce, or redistribute The Open Window Academy's proprietary content, training materials, or course content.
- Use The Open Window Academy's trademarks, logos, or branding in a way that implies official endorsement without written permission.
- Create competing products or services using knowledge or materials obtained from the Platform.
- Share login credentials or allow unauthorized access to your account.
6. Consequences for Violations
Violations of this Acceptable Use Policy may result in one or more of the following actions, at the Company's sole discretion:
Level 1 — Warning
Written warning with specific corrective actions required. Applicable for first-time minor violations.
Level 2 — Suspension
Temporary suspension of account access and/or Affiliate privileges for 30 days. Applicable for repeated minor violations or first-time moderate violations.
Level 3 — Termination
Permanent termination of account, forfeiture of all unpaid commissions, and removal from the Affiliate Program. Applicable for serious violations, fraud, or repeated moderate violations.
The Company reserves the right to skip directly to any level of consequence based on the severity of the violation. In cases involving fraud, illegal activity, or significant harm to the Company or its Members, the Company may also pursue legal action.

All reports will be investigated promptly and confidentially. The Company prohibits retaliation against anyone who reports a violation in good faith.
8. Modifications
The Company reserves the right to modify this Acceptable Use Policy at any time. Changes will be posted on this page and communicated to Members via email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated policy.
